6.  A young man had a venereal disease called genital herpes. He had unprotected sexual relations with a young, married female co-worker but did not tell her about his disease. She later had relations with her husband, who became infected. The husband sued the young man for negligence for not telling his wife of the danger and being the cause of his wife passing genital herpes to him. The young man filed a motion to dismiss the complaint, alleging that the husband had no action against him because there was no legal causation. Will the court dismiss the complaint as a matter of law?

16.  A woman gets a phone call from a man representing himself to be a disabled veteran, asking for funding for the charitable group, “Veterans Welfare United,” that contributes funds to disabled veterans from the Iraq and Afghanistan wars. He tells her that the group is an established and respected national organization that has helped thousands of veterans. He tells her that 80% of the funds collected go directly to disabled veterans. She agrees to sign up to donate through automatic payments of $500 per month from her checking account. After one year, the woman discovers that the group is only 20 months old and that it only provides 40% of its funds directly to disabled veterans, helping no more than a few dozen people since it started operating. She sues the group for misrepresentation, and includes the above facts in the complaint. The group files a motion to dismiss, arguing that the complaint fails to allege the elements of misrepresentation and the case should be dismissed as a matter of law. Will the court likely dismiss the action for failing to state a legal claim?

22. Axiam Inquisition (Inquisition) magazine published a news article about Paul Prude, a famous TV talk show host. The article said that Prude was a vengeful man who once kept actor Xavier Tiger off his program for ten years because Prude thought (falsely) that Tiger had leered at Prude’s wife. Inquisition’s source for this news item was Stan, a servant of Prude. Ed, the editor of Inquisition, knew that Stan was a crack addict and that the money Inquisition was paying him was important to Stan so that he could maintain his drug habit. A journalist of average professionalism would not have believed Stan’s report, but Ed had the unusual habit of believing people quickly and in fact believed Stan implicitly. Prude has brought a libel action against Inquisition, in which he has proved decisively that he never tried to keep Tiger off his show. May Prude recover?

Did defamation occur?

Essay #2 Paul purchased a large house plant, the kind that has leaves that look like elephant ears, to place inside his home.  One day, while dusting the plant, he was horrified to discover spiders crawling all over it.  Paul hates spiders. Paul carefully captured one and showed it to his gardener, Manny.  Manny told him that the spiders were extremely poisonous and that he should get rid of them from his home immediately. Paul promptly visited his local home improvement store, Dowes. Paul explained his situation to a salesperson and was recommended to buy Spider Death, a pesticide manufactured by Safe Chemicals. Paul was allergic to many different chemicals so he asked the salesperson if it would be safe for him to use. The salesperson told Paul he had nothing to worry about because there were many regulations that chemical companies need to follow and Safe Chemicals was considered one of the top pesticide companies. Unconvinced, Paul spoke with the store manager who gave Paul a brochure by Safe Chemicals for Spider Death which stated inside that gloves should be used to prevent allergic reactions. The store manager reassured Paul that Spider Death was safe and that was all the reassurance that Paul needed before purchasing. Paul only looked at the front and back of the brochure, but did not read all of the brochure. Paul took home a bottle of Spider Death and used it on his house plant. Paul did not use gloves. Soon after, Paul became ill due to an allergic reaction and was taken to the hospital for treatment. After slipping into a coma for three months, he is now awake but he is permanently injured due to his allergic reaction.   Discuss the rights and remedies of Paul, if any, and defenses that may be raised by parties he may sue.
