The two regularly argued because Jerry, who was the organization’s “champion,” took wrestling “too seriously” in Ben’s opinion. Ben would often have to remind Jerry that their “sport wasn’t real” and that Jerry “wasn’t really a champion.” In fact, Ben had recently begun to wonder if Jerry hadn’t been dropped on his head one too many times because he seemed to be losing touch with reality. When Jerry learned that the person in charge of the organization decided that Jerry would “lose” to Ben in an upcoming match, Jerry became visibly upset. Jerry knew that immediately following the loss, the referee would hand Ben “his belt” and Jerry simply could not bear that thought. In the days leading up to the match, Jerry was heard muttering to himself, “that belt is mine, he can’t take it away from me. If he does, I’ll get it back no matter what.” On the night in question, Ben attempted to finish the match several times according to the agreed upon plan but Jerry refused to lose. Ben eventually had to use actual force to hold Jerry down and win the match. After the win, Ben was given the championship belt and he hurried out of the arena because he knew Jerry would be angry. That night Jerry drove to Ben’s home and waited for all of the lights in the house to go dark before he snuck up to the back door. Although Jerry believed he was “the champion” and could physically handle Ben, he brought a gun just in case things got out of hand. Jerry pried open the back door and made his way to Ben’s room. Ben awoke to the sound of Jerry making his way through the house and proceeded to confront Jerry in the living room where a struggle ensued. During the struggle, Jerry’s gun went off killing Ben instantly. After sitting in the dark for several minutes staring at his friend’s dead body, Jerry eventually began searching the house until he found the championship belt which he took and then left. After Ben’s body was found the following day, suspicion immediately fell on Jerry and he was arrested. With what crimes, if any, can Jerry reasonably be charged and what defenses, if any, can he reasonably raise. Discuss.
