Belle аnd Jоck hаd а stоrmy relatiоnship, and they had a fight and decided to stop seeing each other. After a few hours passed, Jock decided he wanted to reconcile with Belle. So that fight, he went to Belle's house and knocked on the front door. There was no answer. He went around to the back yard and looked in the bedroom window. He saw Belle on the bed with another man and both were naked. Jock ran back around to the front door and kicked it in. Then he ran back to his car that was parked by the curb near the front door, and he retrieved a loaded handgun from the glove compartment. Then he ran straight up the front walk and into the house. He kept running, and when he got to the bedroom door, he kicked it down, ran into the bedroom, and confronted Belle and the unknown man. Belle screamed at Jock and Jock yelled at the man to "get out of this house!" The man raced out of the bedroom with Jock in pursuit; Jock kept holding out the gun and pointing it at the man, as he chased the man through the house. The man ran through the front door space, jumped over the broken door, and started running down the street. Jock followed right behind the man and kept chasing him for three blocks. Suddenly, the man jumped into an empty car that was parked at the side of the road. Jock screamed, "No you don't!" and pointed the gun at the windshield. Then Jock fired through the windshield. The bullet hit the man, Vic, in the head and he died instantly. Jock was arrested soon afterwards because Belle called the police. Assume that the prosecutor charges Jock with first-degree murder and that the mens rea for this crime is defined as an intentional killing with deliberation and premeditation. The trial judge instructs the jury that the other verdict option is second-degree murder, which is an intentional killing with no deliberation and premeditation. Jock is convicted of first-degree murder. On appeal, his defense counsel Amy argues that the conviction should be reversed, and that the verdict should be reduced to second-degree murder. What are the strongest arguments that the defense counsel can make to demonstrate the insufficiency of the evidence to support the conviction for first degree murder? Jock shot only once, which indicates that he did not use a method of killing that demonstrated a plan to kill. Jock did not know the victim, which suggests that he lacked a motive that would demonstrate a plan to kill. Jock had no plan to shoot Vic when he did, because he chased Vic and then shot at him impulsively. Jock's provocation by Belle and Vic shows that Jock was acting under the influence of an extreme emotional disturbance, which is inconsistent with the formulation of a plan to kill.
