Since recently his business had suffered due to huge wholesale stores which have opened in his part of the city, Larry decided to do major improvements to the appearance of his store and to up-grade the merchandize that he sells. Since his front door was old and decrepit, Larry decided to have it re-designed to attract more customers. Larry contracted with Archie, an architect who he placed in charge of the store renovation. Before beginning the renovation, Larry spoke to The Glass Experts, a manufacturer and supplier of glass doors for retail establishments. Larry told The Glass Experts that he wanted to have a nice tempered glass door installed in his store. However, in an effort to save Larry some money on the renovation, The Glass Experts told him that they could install an ½ inch thick plate glass which would cost one-third as much as the tempered glass. Further, The Glass Experts told Larry that many of the retailers in the area were using plate glass for their doors and that the plate glass was “very safe”. Larry then instructed Archie to have plate glass installed in the front door rather than tempered glass. Although Archie agreed to do so, he warned Larry that tempered glass was much stronger than plate glass and that if tempered glass broke, it tended to break into pieces with rounded edges, while plate glass would shatter. Nevertheless, Larry had the door installed with plate glass purchased from The Glass Experts and the store re-opened for business a few weeks later after all of the renovations had been complete.Shortly after the store’s opening, a shopper and his seven-year old son came into the hardware store. As they were leaving, the boy pushed hard on the glass instead of using the door handle to open the door and the glass shattered, severely injuring his hand.
