Essаy 2Lаrry аnd Earvin began a bathrооm remоdeling business together several years ago. Not long after their business began focusing on luxury homes, Earvin asked Larry if he had ever thought about stealing from the homeowners who employed them. Larry responded, “not really,” but that he “was willing to listen.” Earvin explained to Larry that he thought Larry (who was much smaller than Earvin) could hide in the attic after they finished work on a Friday. Earvin would return later that evening, Larry could let him, and together they would remove the valuable property from what they thought would be an empty home. The homeowner had moved into an Airbnb at the beginning of the remodeling project.   Following work on Friday evening, Larry climbed into the attic and fell asleep. While Larry was asleep, the couple who owned the home (Martin and Mary) unexpectedly returned with a cot for the evening because a pipe burst at their Airbnb. Larry awoke around midnight, checked his watch, and saw that he had approximately one hour before Earvin was to appear at the front door. Larry listened to make sure that no one was in the home. Larry heard nothing because the homeowners had already fallen asleep at the opposite end of the house.   At the appointed time, Larry began to make his way to the front door to meet Earvin. Martin heard Larry hit the floor after jumping down from the attic and began to investigate. At this point, Earvin was at the front door and attempted to turn the knob to see if it was possibly unlocked. It was not. Larry turned a corner leading to the front door and ran into Martin. Larry and Martin began to struggle which prompted Mary to investigate. Martin began to get the better of Larry until Larry grabbed a hammer lying nearby and struck Martin in the head. Mary entered the hallway just as the hammer came crashing down on Martin’s head. Mary ran back into the room where she and Martin were sleeping. She locked the door and proceeded to call 911. As she began to run back to the room, Larry threw the hammer barely missing Mary’s head. After throwing the hammer, Larry ran to the front door and told Earvin they had to leave right away. Martin survived his injury and was able describe his assailant to the police. Earvin and Larry were arrested the following day.   With what crimes, if any, can Earvin reasonably be charged and what defenses, if any, can he reasonably raise. Discuss.
