In 1939, Clatsop County, Oregon conveyed a lot “to the City of Seaside, provided that the property shall be used by the City for municipal purposes and for no other purpose, and in the event that the same shall not be used or continue to be used, then said real property and the whole thereof shall revert to Clatsop County, without any Act of or by Clatsop County.” The city built and operated a municipal pumping station on the lot until 1990. In 1993, the city sold the lot to Jessie for $300,000, and he lived there and ran a candy store there until he died intestate last month. The county has never objected to Jessie’s use of the lot.
