Jeremy wаs strоlling dоwn the streets оf Dаnville one sunny Sаturday morning, when he spied the glint of a shiny object lying near the top of a heap of discarded items in a public trash can. Gingerly, he reached into the trash can to retrieve the article. To his surprise, it was a bright silver necklace with a sparkling blue topaz pendant attached. He glanced around, but no other people were near the trash can, and no one further down the street seemed to care what he was doing. Jeremy put the necklace in his pocket and took it home. Once there, he telephoned his girlfriend, Candace. Jeremy told her what had happened, and stated, “Candace, this necklace is yours. This is your birthday present from me.” He described the necklace in detail and promised to bring it to her birthday party that evening. He wrapped it up and put a label on it that read “For Candace.” On the way to Candace’s birthday party, Jeremy was knocked down by a passing scooter driver and was taken to the hospital with minor injuries. The package with the necklace in it fell out of his pocket during the accident and was discovered on the sidewalk several hours later by Anna. Anna read the label, opened the package, put on the necklace, and kept walking down the street. Suddenly, a girl named Georgia started yelling at Anna, “You have my necklace! Give it back to me!” Georgia explained that she had thrown the necklace in a trash can that morning because she had suddenly decided to get rid of all her silver jewelry. Two hours later, Georgia had changed her mind and had gone back to retrieve the necklace, only to find it missing. Unconvinced and unmoved by Georgia’s story, Anna refused to give the necklace back. Candace was unreasonably annoyed with Jeremy for not coming to her birthday party. She refused to talk to him and broke up with him that night via a single text. Jeremy made a full recovery. Both Jeremy and Candace have posted on social media claiming ownership of the necklace and asking for it to be returned if found. What property rights (if any) do Georgia, Jeremy, Candace, and Anna have in the necklace, and why? Tips: Organize your answer by following the necklace’s travels from person to person. Do not discuss adverse possession.
