Mike and Darryl, computer experts, decided that they were going to meet up for the purpose of hacking into the database of local home-based business, David’s Doorknobs (owned by David), for the purpose of stealing the personal information of all of David’s clients. On a not so unusual evening at about 10:00 pm, Darryl entered Mike’s home, logged onto Mike’s laptop computer and breached David’s computer firewall, thereby entering David’s home computer and gaining access to all of David’s client information. However, before David’s client information was downloaded, Mike became sleepy and became unconscious. Unbeknownst to Mike, Darryl had dissolved a sleeping pill in Mike’s drink shortly after arriving at his home. Darryl finished the upload of David’s client files, called Lyft for a ride, and left Mike’s home with his computer. When the Lyft driver, Andy, showed up, Darryl sat down in the car, closed the door, and told Andy that he just committed the perfect crime and to drive him to the airport in record time “or else.” Andy raced through the residential neighborhood at speeds exceeding 100 mph even though the posted speed limit was 25 mph. Andy lost control of the car and it struck a homeless person sleeping on the sidewalk, Nellie, killing her instantly. The relevant burglary statute in that jurisdiction reads as follows: “It is a felony to enter the dwelling of another at night with the intent to commit a felony or theft crime therein.” (1) Should Darryl be charged with burglary?
