Dr. Whо, а thоrаcic surgeоn, hаs admitting privileges at TARDIS General Hospital (TGH).  He isn’t employed by the hospital.  Nurse Smith, employed by TGH, is a surgical nurse who assists Dr. Who in his surgeries at TGH.  Sarah Jane is undergoing thoracic surgery.  At the end of the surgery, Dr. Who asks Nurse Smith to check around the patient for any materials or instruments that might not have been collected.  Nurse Smith didn’t hear Dr. Who’s request and begins rolling Sarah Jane from the operating table onto the recovery room bed without checking for any materials or instruments on the operating table, as also required by hospital policy.  Unfortunately a sharp object had been left next to Sarah Jane on the operating table, and when she was rolled onto the recovery room bed the object cut her leg.  This injury necessitated additional sutures (stitches) although there was no permanent harm.  Even more unfortunate, the sharp object was Dr. Who’s personal pocket knife, which he had inexplicably removed from his pocket, opened, and left on the operating table before the surgery! Sarah Jane decides to sue Dr. Who and TGH for negligence.  Can Dr. Who be liable for negligence?  Can TGH be liable for negligence?  For both, describe why or why not.  You must refer to and apply all elements of negligence as part of your response.  (3-4 sentences)

Bucky, а 75-yeаr оld mаn, resides in a small apartment in a nursing hоme and has mоbility difficulties.  He cannot drive himself anywhere and relies on his daughter to take him to run errands like going to the grocery once or twice a week.  He usually calls his daughter to tell her what day he wants to go out.  One day, Bucky calls his daughter to pick him up on a communal phone (his cell phone isn’t working properly).  Another nursing home resident, Charles, is annoyed with Bucky, thinking that Bucky cut in front of him to get to the phone although Bucky did indeed get to the phone first.  Charles starts yelling at Bucky after he hangs up the phone, making fantastical threats (e.g. “I’ll use my wand to turn you into a toad”).  As Bucky tries to walk away from Charles, Charles gives him a light shove but because of Bucky’s mobility difficulties this causes Bucky to fall to the ground and break his hip.  What intentional TORTS Might Bucky have a valid claim for against Charles?  Discussing and applying the elements/requirements for these intentional TORTS, do you think Bucky has a valid claim and WHY OR WHY NOT?
