Also, the object feels hard and heavy.  She reaches into his pocket and takes possession of the gun. She also obtains Pete’s driver license showing he is 15 years old.  Officer Martinez is aware of the law which states that [1] a minor [2] in possession  [3] of a handgun or firearm is guilty of a Felony.  Officer Martinez arrests Peter for Felony gun possession. Pete’s lawyer asserts his rights were violated under the 4th Amendment and asks the court to apply the exclusionary rule to suppress  the recovered firearm.  Discuss the legality of the initial stop, frisk and arrest.
