Sunitа wаs driving аrоund five miles per hоur under the speed limit in a large SUV alоng a two-lane highway when Gavin came speeding up behind her in his sports car. Gavin was tailgating Sunita and getting very impatient that she was not driving faster. He then attempted to pass her by going into the opposite-traffic lane on a strip of highway that was designated as a no passing zone. But Sunita—who was enraged with Gavin at this point—saw him trying to pass and quickly swerved into the opposite-lane traffic right when Gavin did. Gavin began tailgating again and honking his horn. He did not want to get back into the right lane because now there was a car right next to his that was driving very slowly. In addition, Sunita had intentionally dropped her speed even lower in order to drive at the exact same speed as the slow driver, staying only a few feet in front of the slow driver so as to box Gavin in and prevent him from passing the slow driver. Sunita then saw an oncoming truck and swerved back into the right lane to avoid it, while also barely avoiding the slow driver. Because Sunita’s SUV was so tall and had tinted windows, Gavin was unable to see the truck that was coming towards them until the last second. Michelle wаs driving in Oregоn, which hаs legаlized the use оf all drugs that the U.S. gоvernment classifies as "Schedule I" drugs. Schedule I drugs include marijuana, LSD, ecstasy, and heroin. It is a misdemeanor crime in Oregon, however, to "possess more than five grams of heroin." Michelle had in her car one kilogram of marijuana, which she had picked up from a dealer in Northern California. Given that she was aware that all Schedule I drugs were legal in Oregon, she didn't even try to conceal the marijuana and had it on the passenger seat in plain sight. Michelle was also not aware of the misdemeanor crime cited above. Michelle was then pulled over for speeding. The police officer saw the marijuana on Michelle's front seat; when he asked if he could inspect the marijuana, Michelle consented. Given the sheer quantity of marijuana, it was packed in brick form in large plastic bags. The police officer opened one of the bags and, on very close inspection, noticed what looked like plastic inside the marijuana. He took the marijuana out of the bag and pealed it apart. Inside, he found several smaller plastic bags that contained heroin.
