Dаvid runs аn аutо parts cоmpany that manufactures and sells many autо parts, including replacement headlight bulbs. Paula enters David’s store and asks for a recommendation on a good replacement headlight bulb for her car. Paula tells David what kind of car she drives, and David recommends a particular bulb for her. The bulb is in a small box with a price of $10 listed on it, and some advertising information visible on the packaging. Paula takes the bulb from David and pays $10 in cash, obtaining a receipt indicating the date, product name, and amount paid. Paula takes the bulb home and installs it in her car according to the written instructions. On the back of the instructions, which were in the box, there is a provision in small print that states “Customer agrees that any liability related to this product shall be limited to the cost of the product.” Paula does not read the back of the instructions, or notice the provision. A few days after installing the replacement bulb, when Paula turns on her headlights, the bulb overheats and explodes, catching her car on fire. Paula escapes without injury, but her car, worth $10,000, is totally destroyed. When David recommended and sold Paula the bulb, David did not know that this particular bulb had a tendency to spontaneously explode due to overheating. When Paula tells David about the explosion, David apologizes for the inconvenience and offers to refund her the $10 she paid for the lightbulb, stating his liability was limited to that amount. Lаurа, the оwner оf аn apartment building dоwntown, enters into a written lease agreement with her new tenant Tony for an 18-month lease, with a monthly rent of $1,000 due at the 1st of each month. Tony has only just turned 17 years old at the time he enters into the lease agreement, but he has nowhere else to go and needs a place to stay, so Laura agrees to lease an apartment unit to him. After Tony has lived at Laura’s apartment building for three months, paying his rent timely, Tony informs Laura that he lost his job and will be looking for a new source of income. Laura is concerned that Tony will not be able to pay rent for the remainder of his lease. Laura informs Tony that he will need to pay the next three months’ rent on the 1st of the upcoming month, as a security deposit to ease her concerns, or she will evict him immediately. Tony panics because he cannot afford to lose his housing right after losing his job, so he agrees to Laura’s demand to pay three months’ rent ahead of time. However, on the 1st of the next month, Tony only pays that month’s rent. Laura immediately tells Tony that he is evicted for failure to pay, and that she will sue him for the remaining rent owed.
