Alice decides tо dо sоmething nice for her friend Phillip. Alice knows thаt it hаs аlways been Phillip’s dream to go paragliding in Switzerland, but that he cannot afford the expensive trip. Alice promises Phillip that she will pay for his travel to Switzerland, saying “Pack your bags, I’m going to make your dreams come true. I’m sending you to Switzerland. I’ll pay for the round-trip ticket, and you can do whatever you like while you’re there.” A round-trip ticket to Switzerland costs $10,000, while the cost of paragliding in the Swiss mountains is $3,000. Phillip thanks Alice for her generosity, and states he is determined to find a way to raise the funds to pay for paragliding. Phillip decides to sell his prized baseball card collection, which is valued at a fair market value of $4,000. Phillip enters into a valid written contract with Benjamin for Benjamin to buy Phillip’s baseball card collection for $4,000. Before they make the exchange, Phillip excitedly tells Benjamin that he is selling the card collection in order to afford to go paragliding, since Alice is paying to send him to Switzerland. Benjamin, who knows that Phillip needs to raise funds in order to make his dream come true, threatens to pull out of the purchase unless Phillip agrees to reduce the price of the card collection to $3,000. Phillip knows that he has no other way to pay for paragliding, he doesn’t have time to find another buyer for the card collection, and this price will still allow Phillip to pay for paragliding, so Phillip reluctantly agrees to modify the price. Phillip sells the card collection to Benjamin for $3,000 and uses the funds to purchase a nonrefundable paragliding session in Switzerland. Phillip goes to tell Alice how excited he is that he will be able to afford paragliding when he’s in Switzerland. Alice then tells Phillip that she changed her mind, and she will not be sending Phillip to Switzerland after all. Discuss Phillip’s rights with respect to Alice and Benjamin.
