She cultivates a relationship with him and eventually offers to pay him $500 if he will vote for a bill that she favors. In fact, the man is a total fraud and is not a state senator. The State has charged Stacey with Attempted Bribery of a State Official. Stacey is quite embarrassed (both for being foolish and for getting caught). She claims that she has a valid impossibility defense because the man was not actually a state official. Does Stacey have a viable impossibility defense under either the modern common law or the Model Penal Code? (See MPC § 5.01.)
