Gretchen is brоught tо the emergency rоom (ER) of Cаllous Hospitаl (CH) аfter a car accident. Following an initial examination and x-ray, the ER physicians believe Gretchen needs a CT scan to better identify internal injuries. However, the CT machine at CH is out of order, and has been for a few weeks because the hospital CEO won’t approve the funds to repair it due to the poor financial state of the hospital. The CH ER physicians decide it’s best to transfer Gretchen to Mega Hospital (MH), which is only 5 miles away, and place Gretchen in an ambulance owned and operated by CH. Shortly after departing CH and less than a mile away, Gretchen experiences cardiac arrest in the ambulance. The paramedics stop the ambulance and call in to CH and ask to bring her back to the CH ER, but the CH ambulance dispatcher directs the ambulance to MH because the ER director wants to shut the ER down for the evening to attend a party. The ambulance continues to MH, but Gretchen dies just before reaching the MH ER when the paramedics in the ambulance are unable to resuscitate her. It’s likely that had she been taken directly back to CH when requested by the paramedics, Gretchen could have been resuscitated. ANSWER BOTH QUESTIONS!!! (EACH QUESTION WORTH 5 POINTS) a. The federal government is considering bringing a lawsuit for an EMTALA violation. What are the requirements of EMTALA and did Callous Hospital violate EMTALA, and WHY OR WHY NOT? (1-2 sentences) b. Gretchen’s spouse is considering bringing a negligence claim against Callous Hospital and Mega Hospital for wrongful death. Does the EMTALA statute help her in her case, and if yes how; if no why not? Referring to the elements of negligence in your analysis, will Callous Hospital and/or Mega Hospital be found liable? (3-4 sentences)
