The Behelfer Family Unit #7A Franchisee, LLC (doing business as Rogers’ Rockin’ Treats) is constructing a 2,500 square foot outparcel at Waldo Downs Racetrack and Shopping Plaza. Under the city approved site plan and the recorded Covenants, Conditions and Restrictions (Alachua County Clerk of Court Official Records Book 1251, Page 257; the “CCRs”), Waldo Downs must keep a consistent design through the entire Plaza. While Waldo Downs has tenants with which it has created build-to-suit and “vanilla shell” leases, Behelfer will take a ground lease for its building (including a drive-through window), patio seating, and parking lot.
