Supplier and Retailer have a signed contract under which Supplier will deliver custom holiday inventory to Retailer for $100,000. Two days before delivery, Supplier says: “Pay an additional $20,000 or we won’t deliver.” Retailer, under pressure, signs a written modification agreeing to the extra $20,000. After the holidays, Retailer refuses to pay the extra $20,000, claiming the modification is voidable due to duress. Supplier sues to enforce the modification.
