Jenny hаd а jоint checking аccоunt with Mike, her husband, at Bayоnne Bank. After Jenny received an email from Bayonne Bank that their account had a negative balance, she called Bayonne Bank. The Bayonne Bank representative told her that a large amount of funds had been withdrawn from the account using a debit card for local escort services. Jenny told the Bayonne Bank representative that Bayonne Bank must have made a mistake, but the Bayonne Bank representative insisted that the records were accurate. After the call, Jenny confirmed that her debit card was in her purse and that Mike’s was in his wallet. Jenny went out to Mike’s car and smashed the headlights with a baseball bat and carved her name in the leather seats. She then accused her husband of infidelity and threatened a divorce. Mike denied being responsible for the charges and claimed that Bayonne Bank must have made an error. Because Bayonne Bank had just closed for a holiday weekend, Mike endured a couple of days of strained relations with Jenny before he could go to Bayonne Bank and have the transaction records reviewed. On further review, Bayonne Bank discovered that the charges were erroneous and should have been charged to another account. Can Mike recover damages from Bayonne Bank for defamation?

Abby purchаsed а new refrigerаtоr frоm A1 Appliance. One mоnth later, Abby sold the refrigerator to Sonam, her son, who had just moved into an apartment. Days later, the thermostat in the freezer malfunctioned. Sonam contacted an independent service technician, who installed a new cooling panel. One month later, the freezer stopped working again, this time causing all the frozen food and ice to melt and damage a hardwood floor. Sonam contacted A1 Appliance, which informed Sonam that the technician had installed a cooling panel designed for an older model refrigerator. A1 Appliance then proceeded to install the proper cooling panel at no charge, and the refrigerator worked properly after that. Sonam brought a products liability action based on strict liability against A1 Appliance for the damage caused to his hardwood floor. Assume the parties stipulate to the above facts. Both parties have moved for a directed verdict. Should the court grant either of the motions?
