Essаy 2 (1/3 оf Exаm Grаde) In respоnse tо a pandemic (i.e., an epidemic of an infectious disease that has spread across a large region, multiple continents, or worldwide), State X enacted several emergency orders.  Among the orders were the following provisions: (1) Restaurants, bars, and any other indoor location where attendance/occupancy exceeded 50 people was limited to 50% occupancy; (2) houses of worship were not allowed to meet indoors, but outdoor gatherings were permitted, provided social distancing measures were in place (e.g., each person separated by at least 6 feet and wearing masks at all times); (3) singing and chanting were forbidden; and (4) services could last no longer than 30 minutes.  Supermarkets and retail shopping stores are allowed to remain open provided all people inside wear masks and maintain social distancing of at least 6 feet apart.  State X lifted social distancing restrictions on barbers, hairstylists, and manicurists.       The governor of State X enacted the above emergency orders because of the highly infectious nature of the virus of concern in this pandemic.  According to State X scientists, the virus spreads mainly by person-to-person contact through respiratory droplets which may be transmitted through breathing, coughing, sneezing, or talking.  State X submits that the emergency orders with respect to houses of worship are necessary because houses of worship involve (1) large numbers of people mixing from different households; (2) in close proximity; (3) for extended periods of time; and (4) with singing/chanting.  Church sues State X to enjoin enforcement of the emergency orders as to the Church.  Church submits the emergency orders are unconstitutional.  While Church regularly draws over 5,000 congregants to Sunday services, there are numerous other churches and houses of worship which do not even reach 50 attendees/congregants.  State X files a motion to dismiss.  How should the court rule on State X’s motion to dismiss?
