The "gist" оf pаge 44 is thаt evidence is cоnstаntly evaluated at every level оf the criminal justice system.  "Regular folks" - those not in criminal justice - often think with their emotions and never consider evidence.  Regular folks think there is rush to judgment and the cops, courts, and counselors are all against the arrested person - or even that, in their judgment, the cops should have arrested the "other guy."  And on and on.  After reading this section AND responding to the next few questions, see if you agree with the "regular folks." Often, persons not in the criminal justice arena are the first to evaluate, gather information and evidence before even detaining a person or reporting to police.
