Essаy 1 Richаrd is аn attоrney whо practices entertainment law in Century City, Califоrnia.  Paul knows of Richard by reputation, and believes that Richard will be able to help him market his screenplay. The screenplay is based on a true story involving the work of a major motion picture star who helped to develop a method of encrypting, or encoding secret messages during World War II.  Richard and Paul met and discussed an arrangement whereby Richard will represent him in discussions with potential filmmakers who may be willing to option or purchase the rights to make a film based on Paul’s screenplay for a limited time.  The arrangement provides that Richard will negotiate any possible sale of the screenplay, and be paid a percentage of money actually paid from any potential motion picture deal.  Also, the arrangement provides that Paul will retain creative control as it relates to the specific film maker, the specific director and the casting. Richard met with Les Weinberg, the head of a major studio, after Les had an opportunity to read the screenplay. Richard made sure not to reveal that Paul was the writer, as Les and Paul had previously made a movie together, and each had stated that that they would never work together again. Les requested a number of revisions to the screenplay that he said needed to be made, but based on Richard’s assurances that the screenplay revisions would be made, Les agreed to pay a non-refundable $100,000.00 amount to option the screenplay, with the changes that Les required to be made to the screenplay. Richard accepted the option payment. Richard deposited the $100,000.00 in his law firm account.  The account is held in the name of the firm that Richard works for, which is a limited liability partnership. Richard decided that because of the problems that Les and Paul have had working together, Richard would release Paul’s screenplay under a pseudonym (a false author name) and personally handle the writing of the revisions. The film goes into production and is released.  Paul discovers for the first time the arrangements made between Richard and Les, and sues to enjoin the exhibition of the film, to collect damages, and demands payment of the $100,000.00 held by the firm.1. What rights and remedies, if any, does Paul have against Richard?
