Dave believed that Pete, his next-door neighbor, was one of those Zombies. One Saturday, Dave called Pete on his phone to complain that Pete’s children were playing in Dave’s yard and had broken the fence in order to get into the yard. Pete went out to his yard and yelled into his phone, while gesturing at Dave’s house, that “If I had a gun, which I don’t, I’d come over there and shut you up!” The next day, as Pete was loading his children into his car for a trip to the beach, Dave ran toward the car while wielding an axe. Dave dropped the axe but managed to throw a rock, hitting Pete’s car as Dave drove away. The rock cracked the rear window of the car and Pete had to console his crying children as he tried unsuccessfully to find a vehicle glass repair shop. Returning home, Pete parked his car on the street and he and the children ran into the house while glancing anxiously toward Dave’s house. Later that night, Dave snuck over to Pete’s car and cut the brake lines, hoping Pete would have an accident and be taught a lesson. The following morning Pete was afraid to go to work so he stayed home with his children who refused to leave the house. Pete’s sister, Penny, took his car to get the window repaired. While on a highway overpass the brakes failed, the car jumped the guardrail and landed on the street below. Penny was severely injured.
