Questiоn 1 Rаdiо Stаtiоn V107 in North Coаst has been struggling to raise its audience numbers and decided to use a series of promotions to spark interest. Its most recent promotion involves one of the lesser appreciated muscle cars of the 1960s and 1970s, the AMC Matador. While the Matador had its moments in a rising sun, including a role as the villain’s car in the James Bond Movie, The Man with the Golden Gun, it was never as popular as such cars as the Chevy Camaro or the Ford Mustang. Indeed, it has made one list of the ten worst cars ever made. Nevertheless, collectors like them because they are increasingly hard to find and rather cool looking. For purposes of the promotion, the station had purchased an AMC Matador which was periodically driven around by various local North Coast personalities and V107 disk jockeys. Periodically the radio station would announce, “The Matador is on the move and headed towards….” The first person to find the parked car and its driver and answer a question about a song that the station played within the last hour would win a prize, such as concert tickets or cash. For the grand prize, however, which was to be the Matador itself, the listener would have to find the car and its driver after it had been driven by Guillermo Capettilo, a famous Mexican musician, actor, and bull fighter. On November 12, 2024, the station announced, “This is no bull, Guillermo has taken the controls of the Matador and is heading toward his favorite restaurant in Twinsburg. Both Mike Scharf and Jessie Berg were listening at the time, and they both immediately understood what the message meant. They knew that this was not a drill, and that the grand prize was on the line. Both of them wanted the Matador badly. Berg, a struggling medical ethicist was tired of driving her old 2012 Honda Civic and was hoping for an upgrade. Scharf, an international lawyer specializing in international arbitrations, who was not driving a Honda Civic, collects classic cars and was desperate to add the Matador to his collection. Berg and Scharf had never met, and neither was initially aware of the other as they set out to find Capettilo and the Matador. As each approached the Twinsburg exit on the highway at speeds in excess of the speed limit, they both spotted the other. Each was able to make out the V107 bumper sticker on the other’s car, and each concluded that the other might also be after the grand prize. They began jockeying for position to be able to get off the exit first. All the while, the radio station disk jockey was egging on the station’s listeners, saying, “You better hurry, the Matador may be on its way again anytime soon.” As they approached the off ramp, each attempted to pass a more slowly driven pickup truck driven by Richard Gordon. Gordon, who owned a plumber’s supply company, was delivering a load of bathroom fixtures to a Twinsburg contractor. Berg passed Gordon quickly on his left and Scharf did the same on the shoulder of the highway quickly on his right. Each then cut in front of him into the exit only lane, where Gordon was headed, also. Panicked by the blur of the cars and the close and quick cuts in front of him, Gordon lost control of his truck and crashed into a wall on the side of the highway. The accident caused him to lose consciousness, and Gordon cannot remember the precise details of the accident, including which car was responsible for his losing control (if he ever knew). No witnesses have appeared who are able to add information regarding which driver might be responsible. At this point Berg was fuming at the person in the other car. On the exit ramp he had straddled both lanes so that she could not pass him. She thought, “that bougie jerk with his hand made suits and his stupid Tesla truck is going to win. Rich jerks like him always win after trampling over the likes of me.” Having worked herself into a frenzy, she concluded that her only chance of winning would require her to force Scharf off the road. She thought, "If he is afraid that I'll scratch his precious car, he'll move over. The off-ramp had now gone down to a single lane, with Berg trailing Scharf. She floored it and came quickly on Scharf, threateningly edging toward him. Initially Scharf gave no ground but then he looked again in his rear-view mirror. “She’s willing to risk her life to force me off the road; she’s nuts and dangerous,” he exclaimed. Seeing Berg’s Escort a few inches away from him, Scharf swerved and lost control of the car, which ran through the shoulder and into a tree. Scharf had unbuckled his seat belt in case he would have to win a foot race at the restaurant. On impact with the tree he was thrown through his windshield and suffered serious injury, including the loss of his left hand, which was severed in the accident. When approached by EMTs at the scene, Scharf was sobbing, “my Tesla, my Tesla.” When told that his hand had been shaved off, he looked at his bleeding stump and cried out “my Rolex, my Rolex.” Neither Scharf nor Berg arrived in time to win the car. An Ohio State Trooper had observed their shenanigans for an overpass and called for additional cars. He arrested Berg at the restaurant parking lot for speeding, reckless driving, and fleeing the scene of an accident. The Trooper told Berg that she would also be charged with vehicular assault. Two other patrol cars pulled up at the scene of Scharf's accident. After Scharf was stabilized at the hospital, he was also placed under arrest for speeding and reckless driving along with passing on the shoulder. The contest's lucky winner was Ken Margolis. He did not know of the contest, but stopped at the restaurant thrilled to see Capitally with whom he wanted to talk about music and their mutual love of Flamenco. All the same he was asked the trivia question, “Members of what popular Cleveland disbanded band joined with Eric Carmen to form the Raspberries.” Margolis responded, “Who doesn’t know that? It was The Choir.” Richard Gordon has sued the radio station and Scharf and Berg for his injuries and the damage to his pickup truck. Scharf has consulted with a lawyer and brought a tort action against Berg. Analyze the claims.
