The check was made payable to Plaintiff and payment was stopped after its delivery to Plaintiff, because John Davies was no longer employed by Defendant. Davies was indebted to Plaintiff due to a loan from Plaintiff which he obtained long before becoming employed by Defendant. At the request of Davies, and merely as a convenience to him, for a period of several months Defendant sent its checks to Plaintiff in payment of the installments due to Plaintiff by Davies. It then deducted the loan payments from Davies’ salary. Plaintiff did not know of the arrangement between Defendant and Davies. Plaintiff could not collect the unpaid loan amount from Davies and then sued Defendant. Defendant raised the affirmative defense that the check was given to Plaintiff without consideration and no enforceable agreement existed between Plaintiff and Defendant. The trial court ruled for Defendant, and Plaintiff appealed.
