Des Mоines Dusters Ultrаbаll Cоrp.United States District Cоurt for the District of East Carolina In this action, a former minor-league ultraball* player brings suit against the Des Moines Dusters, an incorporated sports franchise that is a member of the professional ultraball league. The former player alleges that the Dusters violated East Carolina** wage and hour laws by paying him illegally low wages during the professional season, as well as forcing him to perform work for no wages during the winter off-season. The professional ultraball league is made up of 20 member franchises, each of which represents one of the well known, highly paid major-league teams as well as an affiliated minor-league team. To identify and recruit new players, professional ultraball uses a centralized Scouting Service that travels the country on behalf of all 20 teams, evaluating college and high school players. Some of the 20 teams also conduct their own individualized recruiting trips. On the basis of what the scouts report, the teams hire new players in a centralized "draft" by all teams that takes place in Las Vegas, Nevada each year. Plaintiff Rutherford James is a current full-time resident of Jacksonville, Florida. He grew up in East Carolina, where he attended a local high school and then was a varsity athlete at East Carolina University. While in university, James was scouted by the professional ultraball league, which sent recruiters from various teams to meet with him and watch him play. James was drafted in 2015 after being scouted by a recruiter from the Des Moines Dusters organization (Dusters), an Iowa corporation based in Des Moines, Iowa. James signed a contract later that year with the Dusters at the team's headquarters in Iowa. James's contract with the Dusters was a uniform player contract (UPC), which league rules require to be the same for all minor league ultraball players. Under the UPC, players are only paid during the professional season, which lasts about half of the year. They are not paid during the rest of the year. The contract imposes off-season training and conditioning requirements that expressly "continue in force" for players "throughout the calendar year." The terms of the UPC are prepared by league officials in New York City. From 2015 to 2020, James played professional ultraball for the Dusters' minor league team. This team was based in Iowa and played its games outside of East Carolina. However, James returned to East Carolina each winter for the offseason, and trained regularly there by following instructions in the "winter work packets" that the Dusters mailed to him in East Carolina. After his contract was not renewed in 2020, he moved to Florida, where he is now domiciled. James filed this suit in East Carolina federal district court in July 2021. He claims that the Dusters violated East Carolina state wage laws (including limitations on overtime and uncompensated labor) by not paying him for his offseason winter work and training while he was employed on the franchise's minor league team.
