Mаtthew wаs tried fоr herоin pоssession in stаte court. The prosecution offered in evidence four Ziploc bags containing heroin, which police officers found on the kitchen counter in Matthew’s townhouse. At a hearing on the defense’s motion to suppress, testimony was presented that established that the police had put the townhouse under surveillance and watched a police informant go to the door of the townhouse, hand three Ziploc bags of heroin to Matthew, and leave. The police then knocked on the townhouse door, identified themselves as police officers, and demanded entrance. Having heard nothing for 30 seconds, the police then broke down the door and entered the townhouse, discovering the heroin. The police had intended to arrest Matthew for the purchase of heroin, a felony. When they got inside the apartment, they discovered that Matthew had left through a back exit. He was later arrested at the nearby gas station. The trial court denied the motion to suppress, and the case is on appeal following Matthew’s conviction for possession of heroin.
